1. Acceptance of these terms

These Terms of Use govern your access to and use of MADEWORKSintelligence.org (the "Site"), operated by Nontoxic Certified Inc., a 501(c)(3) nonprofit corporation organized under the laws of the State of New York ("MADEWORKS Intelligence," "we," "us").

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

We may revise these Terms at any time. Revisions take effect when posted, and the "last updated" date above will change accordingly. Your continued use of the Site after a revision constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

2. Who we are and what this Site is

MADEWORKS Intelligence conducts research and establishes the standards underlying MADE WISE Certified™ and MADE SAFE® Certified. We publish research, guidance, and reference materials concerning substances used in consumer products, including the MADE Banned List (the "MBL"), chemical profiles, product profiles, guides, and related standards documentation (together, the "Content").

The Site is an educational and informational resource. It is not a regulatory authority, a testing laboratory, or a provider of professional services.

3. Content is informational only—no advice

The Content does not constitute medical, health, scientific, legal, regulatory, or professional advice of any kind, and must not be relied upon as such.

Nothing on the Site creates a professional relationship between you and MADEWORKS Intelligence. You should not use the Content as a substitute for consultation with a qualified physician, toxicologist, attorney, regulatory specialist, or other professional. Never disregard or delay seeking professional advice because of something you have read on the Site.

If you believe you are experiencing a medical emergency, contact your physician or emergency services immediately.

4. Accuracy, sources, and limitations of the Content

The Content is compiled from published scientific literature, regulatory and governmental sources, and other third-party materials available to us at the time of publication. Scientific understanding evolves, regulatory lists are amended, and source materials are superseded.

Accordingly:

  • We make no representation or warranty that the Content is complete, current, or free from error.
  • Inclusion of a substance on the MBL reflects our assessment of information available at the time of listing and may not reflect subsequent developments.
  • Substance identification, classification, and hazard characterization vary between sources and jurisdictions. Where sources conflict, our treatment reflects our own methodology, described at [LINK TO METHODOLOGY PAGE].
  • The MBL and related Content apply to MADE certifications and are not statements of legal compliance in any jurisdiction.

You are responsible for verifying any information before relying on it.

5. What listing on the MBL does and does not mean

The MBL identifies substances that are prohibited, restricted, subject to testing requirements, or permitted only under defined conditions within products seeking or holding MADE certifications.

For the avoidance of doubt:

  • The presence of a substance on the MBL is not a statement that the substance is unlawful, unsafe at all exposure levels, or prohibited by any regulatory authority.
  • The presence of a substance on the MBL is not a statement that any specific product containing it is harmful, defective, or misrepresented.
  • The absence of a substance from the MBL is not an endorsement of that substance or a statement that it is safe.
  • References to named products, brands, companies, or manufacturers are made for identification and educational purposes only and do not imply any allegation of wrongdoing.

Our hazard-based methodology assesses intrinsic properties of substances. It does not, and does not purport to, assess risk arising from exposure in any particular product or use scenario.

6. Permitted use of the Site

You may access and use the Site for lawful, personal, educational, research, journalistic, and non-commercial purposes.

You agree not to:

  • Use the Site in violation of any applicable law or regulation;
  • Use any automated means—including scraping, crawling, or data mining—to extract Content, except that responsible academic and journalistic research use is permitted where it does not impair Site performance;
  • Reproduce the MBL or any substantial portion of it in a manner that functions as a substitute for the Site;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site or its underlying systems;
  • Remove, obscure, or alter any copyright, trademark, or attribution notice;
  • Use the Content to create a derivative certification, standard, or rating scheme;
  • Misrepresent your affiliation with MADEWORKS Intelligence, Nontoxic Certified Inc., or any of our programs.

7. Intellectual property and citation

7.1 Ownership

The Content, together with the design, structure, organization, and compilation of the Site, is owned by Nontoxic Certified Inc. or its licensors and is protected by copyright and other intellectual property laws.

7.2 Citation and quotation—permitted

We publish research in order for it to be used. Accordingly, you may quote from, cite, and reference the Content for educational, research, journalistic, policy, and editorial purposes without seeking prior permission, provided that:

  • Quotations are of reasonable length and do not substitute for the original;
  • You attribute the material clearly to MADEWORKS Intelligence, identifying the specific document or page and, where practicable, providing a link;
  • You do not alter the meaning of the material, present it out of context, or use it in a manner that implies our endorsement of any product, company, position, or claim;
  • You do not use the Content, or any citation of it, in advertising, marketing, packaging, or promotional material for any product or service without our prior written permission.

7.3 Reproduction beyond citation

Reproduction of complete documents, substantial portions of the MBL, or Content in bulk requires our prior written permission. Requests may be sent to [EMAIL].

8. Trademarks and certification marks

MADE SAFE®, MADE WISE Certified™, MADEWORKS, MADEWORKS Intelligence, the MADE Banned List, and associated logos, seals, and marks (the "Marks") are trademarks of Nontoxic Certified Inc. [Confirm registration status and correct symbol for each mark.]

Nothing on the Site grants any licence to use the Marks.

The certification seals may be used only by parties holding a current, valid certification licence agreement, and only in accordance with its terms. Use of any certification seal by a party whose certification has lapsed, been suspended, withdrawn, or was never granted is unauthorized, regardless of whether that party previously held certification.

9. Third-party content and links

The Site references and links to third-party sources, including scientific publications, regulatory databases, and other organizations' materials. Those links are provided for reference and do not constitute endorsement of the linked source or its content.

We are not responsible for the content, accuracy, availability, or privacy practices of any third-party site. Your use of any third-party site is at your own risk and subject to that site's own terms.

10. Disclaimer of warranties

The Site and the Content are provided "as is" and "as available," without warranty of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of liability

To the fullest extent permitted by law, Nontoxic Certified Inc., its officers, directors, employees, volunteers, advisors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of, or inability to use, the Site or the Content—whether based in contract, tort, negligence, strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Nontoxic Certified Inc. and its officers, directors, employees, volunteers, advisors, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of the rights of any third party.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles.

[Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.]

15. International users

The Site is operated from the United States. If you access it from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

16. Severability and entire agreement

If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force.

Our failure to enforce any provision is not a waiver of that provision.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MADEWORKS Intelligence regarding the Site.
